CAR ACCIDENT BENEFITS – ONTARIO

In a car accident, both the person at fault and the victim may be entitled to benefits including non-earner benefits, lost wage replacement and much more. However, when you are not the one at fault, you have two claim types you can file: a damage claim against the at-fault driver, and a claim for no-fault accident benefits against your own insurer (or the insurer of the vehicle you occupied at the time of the accident).

CAR ACCIDENTS CAUSED BY AN UNDERINSURED, UNINSURED OR UNIDENTIFIED DRIVER

When you are involved in a hit and run, it may seem the situation is hopeless to gain compensation. However, you are likely to still be eligible to pursue a claim from either:

  • Your own insurance company
  • The Motor Vehicle Accident Claims Act Fund

Similarly, if the driver is identified but does not have insurance or does not have adequate insurance, then you are likely to get compensation from your own insurance company.

Similarly, any private or public property that has slippery floors or an un-shoveled or icy walkway owe a duty of care to anyone who has slipped, tripped or fallen on the premises. Broken stairs, railings and other hazards left unattended may also be grounds for a claim if you are injured.

DISABILITY CLAIMS

Whether your disability arises from an accident or illness, there are often disability policies that are available, and obligated to respond to your loss. Monthly income benefits are available from the policy as well as from aggravated, exemplary and punitive damages where the insurer has acted unfairly or inappropriately, including if they have ignored evidence to justify not paying. This second line of compensation comes when it is found that the insurance company has not acted fairly or correctly including if they have ignored evidence to justify not paying.

INJURIES CAUSED BY AN ANIMAL ATTACK

If you are attacked or injured by someone’s animal, financial compensation for your injuries and compensation for pain and suffering, including emotional distress, financial losses and any out of pocket expenses may be available. Typically, a homeowners or general liability insurance policy will provide coverage for your animal’s misadventure. Ontario residents whose dogs have caused an injury are held liable under the Dog Owners’ Liability Act.
